Given that they are already violating FCC rules by marketing them as license-free, and on frequencies not allocated for space-to-earth communications, I have to wonder what the chances are that those kits were shipped in compliance with ITAR regulations....
(The first TubeSat launch is pending, 1st quarter 2011.... it would probably behoove us all to let the FCC know that we DON'T want these unlicensed& uncoordinated satellites launched!)

From what I can read they are using ISM rules, for earth bound transmitters these would indeed be licence free *but* I do have my doubts if ISM transmitters are alowed in space crafts.
