It appears that Interorbital Systems has sold at least 3 of their TubeSat kits to foreign buyers.
Given that they are already violating FCC rules by marketing them as license-free, and on frequencies not allocated for space-to-earth communications, I have to wonder what the chances are that those kits were shipped in compliance with ITAR regulations....
(The first TubeSat launch is pending, 1st quarter 2011.... it would probably behoove us all to let the FCC know that we DON'T want these unlicensed & uncoordinated satellites launched!)

From what I can read they are using ISM rules, for earth bound transmitters these would indeed be licence free *but* I do have my doubts if ISM transmitters are alowed in space crafts.

Answer in the radio regulations:
1.15 industrial, scientific and medical (ISM) applications (of radio frequency energy): Operation of equipment or appliances designed to generate and use locally radio frequency energy for industrial, scientific, medical, domestic or similar purposes, excluding applications in the field of telecommunications. (Emphasis supplied.)
So, no ISM for long distance work and, in fact, no telecommunication at all for ISM devices.
Seems pretty clear.
