
You can contact eBay security and open a case with them for copyright infringement and/or the use of your images and text without your permission. eBay took my case last month very seriously, and it was resolved in less than three days.

I've been reading this thread for the past day or so and have a couple of questions and comments. First, the comments. In a lot of open source licenses, there is no prohibition on selling the software. Even the GPL does not prohibit selling the software, provided that the conditions of the license are met.
Selling free software does have some merit, such as when the buyer wants it distributed on media (CD-ROM, etc), and the seller wants to recover the cost of the media.
Where I see problems is if the seller claims the software is "theirs" (either explicitly or implicitly by removing copyright notices), or they don't follow the conditions of the license (e.g. distributing only binaries of a GPL licensed application).
So, is the seller really doing something seriously wrong? Or are they merely charging to distribute free software on media?

If the seller has taken text descriptions directly from another's Web site without permission, they are in violation of copyright law.
Same with images.

Well, I don't have any explicit copyright statements on my websites, so I don't think I can claim any legal copyright. Anyway, people are free to use the contents. Of course, thanks to my naivety, I didn't expect to see them being used this way.
In my opinion, it is not a question of whether it is legal or not. It is more about "being nice to your neighbours". I also buy free software on CDs and DVDs because it can save me download time and in most cases it will support the development. But selling a CDROM with 10 MByte of data, which can be downloaded for free... that's also an insult to the environment :-(

Not sure if that is in all jurisdictions, but it is usually the case. In any case, it still is a good idea to include copyright statements, but you do have copyright protection without them.

Well, in that case, you have at least two choices, both of which you exercised here - voting with your feet (i.e. not buying it) and sharing your opinion on this issue with others.
I generally don't buy free software, because of the long turnaround times for the media delivery, it's usually easier for me to simply download the software I need.
