I am not aware of any legislation regarding SDR, applicable to FCC Part 97 (Amateur Radio), in the USA. It doesn't matter if your transmitter is Software or Hardware modulated. (and, when we get right down to it, software is just a different way to wire hardware components together .. but I digress)
It is the effective emission that matters. If the transmitted signal has the appropriate bandwidth and meets the spurious emission limits, then there is no problem.
